Terms of Use

1. Acceptance

By installing or using the Mood Phase app ("the App") or visiting our website, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the App.

2. Eligibility

You must meet the minimum age required by the laws of your country to use the App. The App is for personal, non-commercial use only.

3. License

We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on iOS solely for your personal, non-commercial use in accordance with these Terms.

4. User content

You retain ownership of any custom mood configurations you create. We do not claim rights to your custom mood data.

5. Audio & health disclaimer

The App generates procedural audio including binaural beats, sub-bass frequencies, and ambient soundscapes. These are for relaxation and focus purposes only and are not medical treatments.

Photosensitivity warning: The App displays animated visual effects including rapid color changes, patterns, and shader-based rendering. If you have epilepsy or are sensitive to flashing lights, consult a physician before use.

The App is not a medical device, does not provide medical advice, and is not a substitute for professional healthcare. Do not use the App while driving or operating heavy machinery. You use the App entirely at your own risk.

Moon Apps LLC expressly disclaims all liability for any adverse health outcomes arising from use of the App, including but not limited to hearing damage from prolonged use at high volumes, seizures triggered by visual effects, or any reliance on audio frequencies for therapeutic purposes.

6. Subscriptions & billing

The App offers optional subscriptions and a lifetime purchase, billed by Apple through your App Store account. You can manage or cancel at any time in your device settings. Refunds are handled by Apple. Free features remain available without a subscription.

7. Intellectual property

The App and its content (shaders, audio algorithms, visual presets, UI design) are owned by Moon Apps LLC. All rights not expressly granted are reserved.

8. Disclaimers & liability

The App is provided "as is" without warranties of any kind. We are not liable for any damages arising from your use of the App. Our total liability is limited to the amount you paid us in the 12 months before the claim.

9. Termination

You can stop using the App and delete your account at any time. We may suspend access if these Terms are violated.

10. Changes

We may update these Terms and will post changes here with an updated effective date. Continued use after changes constitutes acceptance.

11. Governing law

These Terms are governed by the laws of Wyoming, USA.
