Terms of Use

1. Acceptance

By installing or using the Mood Phase app ("the App") or visiting our website, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the App.

2. Eligibility

You must be 13+ (and 16+ in EEA/UK unless you have parental consent). The App is for personal, non-commercial use only.

3. License

We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on iOS solely for your personal, non-commercial use in accordance with these Terms.

4. User content

Custom moods you create are stored locally on your device. You retain ownership of your configurations. We do not upload, access, or claim rights to your custom mood data.

5. Audio & health disclaimer

The App generates procedural audio including binaural beats, sub-bass frequencies, and ambient soundscapes. These are for relaxation and focus purposes only and are not medical treatments.

Photosensitivity warning: The App displays animated visual effects including rapid color changes, patterns, and shader-based rendering. If you have epilepsy or are sensitive to flashing lights, consult a physician before use.

The App is not a medical device, does not provide medical advice, and is not a substitute for professional healthcare. Do not use the App while driving or operating heavy machinery. You use the App entirely at your own risk.

Moon Apps LLC expressly disclaims all liability for any adverse health outcomes arising from use of the App, including but not limited to hearing damage from prolonged use at high volumes, seizures triggered by visual effects, or any reliance on audio frequencies for therapeutic purposes.

6. Subscriptions & billing

The App offers auto-renewing subscriptions billed by Apple through your App Store account. You can manage or cancel your subscription at any time in your device settings. Refunds are handled by Apple under its policies.

Free features remain available without a subscription. We may change pricing for future subscription periods with reasonable notice.

7. Prohibited uses

You agree not to: engage in unlawful activity; reverse-engineer, decompile, or disassemble the App; scrape or extract data; attempt to bypass security measures or access controls; or use the App for commercial purposes without our written consent.

8. Intellectual property

The App and its content (shaders, audio algorithms, visual presets, UI design) are owned by Moon Apps LLC or its licensors. All rights not expressly granted are reserved.

9. Feedback

If you send suggestions or feedback, you grant us a royalty-free, perpetual, irrevocable license to use them without obligation to you.

10. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED OR ERROR-FREE.

11. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, MOON APPS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, HEARING DAMAGE, SEIZURES, LOSS OF DATA, OR LOSS OF PROFITS, ARISING FROM YOUR USE OF THE APP.

OUR TOTAL AGGREGATE LIABILITY IS LIMITED TO THE GREATER OF USD $50 OR THE FEES YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless Moon Apps LLC from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.

13. Dispute resolution

Any dispute will first be attempted through good-faith negotiation. If unresolved within 30 days, disputes will be resolved through binding arbitration under the rules of the American Arbitration Association, conducted in Wyoming, USA. You waive any right to participate in a class action lawsuit or class-wide arbitration.

14. Termination

You can stop using the App and delete your account at any time. We may suspend or terminate access for breach, risk, or legal reasons. Sections 5, 8-13 survive termination.

15. Modifications

We may update these Terms at any time. Material changes will be communicated via in-app notice. Continued use after changes constitutes acceptance.

16. Governing law

These Terms are governed by the laws of Wyoming, USA. To the extent litigation is permitted, exclusive jurisdiction lies with the courts of Wyoming.

17. Apple-required terms

These Terms are between you and Moon Apps LLC, not Apple. Apple has no obligation to maintain or support the App. Moon Apps LLC is responsible for any warranty claims; Apple's obligations are limited to refund of the purchase price (if applicable). Apple isn't responsible for claims relating to the App. You represent you're not in an embargoed country or on a restricted list. Apple and its subsidiaries are third-party beneficiaries and may enforce these Terms.
